DECISION OF COMPETITION APPEAL TRIBUNAL

The long awaited decision by the Office of Fair Trading regarding the appeals by Hays, Eden Brown and AndersElite has been announced.

The three recruiters were fined almost £40 million between them when the OFT made its decision of 29 September 2009 in Case CE/7510-06 Construction Recruitment Forum. The Office of Fair Trading found that 7 recruiters had infringed Chapter I prohibition imposed by section 2 of the Competition Act 1998. Hays were fined £30.3 million, CDI £7.6 million and Eden Brown £1.0 million.

The appeal decision has seen these fines reduced to, Hays £5.8 million, CDI £1.5 million and Eden Brown £477K. The decision of the Tribunal was unanimous in each case.
