Introduction Whilst the employment tribunals are there to uphold very important rights for employees, there does seem to be a tendency by some claimants (and some respondents) to use the process as a blunt instrument to encourage unjustified settlements or outcomes. Statistics show that each year around 80% of claims do not go to a full hearing. Pay outs are made simply to avoid disruption and legal costs. I have been at the forefront of efforts to challenge the ‘serial litigant’ problem which has recently resulted in the problem being investigated with plans at central level to address this. My experience includes dealing with 25 claims from one individual alone… Course content An update on the serial litigant threat Spotting nuisance claimants in the pre-action stage Relevant case law on misconceived claims and costs Responding to nuisance claims- pleadings Due diligence and investigations Case management and directions – striking out claims on the papers Managing legal costs- strike out at £150 per go?
