I used to work for a company who specialised in IT recruitment. We had a claim made against us by Mr Berry in the employment tribunals because we specified quite carelessly that our ideal candidate would be a recent graduate. The claim was filed against us and others, you could tell by the way his particulars were drafted. He also doesnt use his home address, if I remember correctly he used an RAF club or something like that as his address for service
 
I practised law for 7 years prior to joining Exposed Solutions as Commercial Manager hence I drafted a very robust defence and filed it with the court. Mr Berry also got in touch with ACAS claiming that we had made various offers of settlement including one for 5,000. He then called me and did his threatening act, however I think he quickly realised he had bitten off more than he can chew because I am more than equipped to deal with such a phone call and left him in no uncertain terms as to our position.
 
We got rid of him after about 6 weeks by simply defending absolutely everything he claimed in the most vigorous fashion and applying to the tribunal to have his claim struck out at every opportunity.
 
It cost me about 5 man hours however there was no way I was letting this scam artist get away with anything.
 
The moral of the story is ensure your consultants are well briefed on drafting adverts and if he threatens you stand up to him, he doesnt have the funds to launch a worthwhile claim in the Employment Tribunals and no solicitor on the planet is going to take it on a no win no fee basis because the majority of his claims will be complete shams. Also speak to your solicitors, if he is contacting you prior to launching any claim and acting in a threatening manner this needs to be drawn to the attention of the tribunal and depending on the nature of his behaviour perhaps the Police as well.
 
PLEASE DONT SETTLE THIS MANS CLAIMS, HE WILL KEEP DOING IT UNTIL WE STAND UP TO HIM.
