CONSERVATIVES USE IR35 AS POLITICAL FOOTBALL

CONSERVATIVES USE IR35 AS POLITICAL FOOTBALL

ClearSky Accounting welcomes any move to simplify IR35 but believes the Conservatives indication that they may scrap is just blatant electioneering.

In response to the Shadow Business Minister Mark Prisks comments in The Telegraph yesterday, ClearSky managing director Derek Kelly, states: Prisks wielding of IR35 as a piece of Labour law to be got rid of as part of the Tories new broom sweeps clean stance is electioneering, and quite blatant electioneering at that.
Attempting to scrap IR35 would involve serious pressure from the unions, and indeed from the whole industry that has built up around the introduction of IR35.

Contractors, for their part, would end up receiving poorer quality or at least less specific taxation advice, which would have a knock-on effect for their financial circumstances as a whole.

As a result we would suggest that the Conservatives focus their efforts on simplifying the rules of IR35 and providing the necessary resources and encouragement to the HMRC to enforce the rules this legislation more rigorously.
