Whilst the employment tribunals are there to uphold very important rights for employees, there does seem to be a tendency by some claimants (and some respondents) to use the process as a blunt instrument to encourage unjustified settlements or outcomes. Statistics show that each year around 80% of claims do not go to a full hearing. Pay outs are made simply to avoid disruption and legal costs.

I have been at the forefront of efforts to challenge the & lsquo;serial litigant’ problem which has recently resulted in the problem being investigated with plans at central level to address this. The object of this presentation is to share helpful information with managers and employment lawyers so that cases of this type can be dealt with proportionately and promptly as the Overriding Objective suggests they should. My experience includes dealing with 25 claims from one individual alone&hellip
