APSCo and the Agency Conduct Regulations Review

APSCo is working closely with BIS on the Government’s proposed consultation on the review of the Agency Conduct Regulations. Following an initial meeting with Ed Davey, the then BIS Minister last November, APSCo established a Conduct Regulations Working Group to set the main focus and collate evidence based content for a response to the consultation.

The Group, which is made up of volunteers from APSCo’s membership has already had its first meeting to start to shape a strategy for the consultation and will continue to engage with BIS throughout the process.

“APSCo has always been at the very forefront of discussions and consultations at the highest level to ensure that our members are kept informed of the legislative and political employment landscape,” said Ann Swain, Chief Executive of APSCo. “We are very much looking forward to further engaging with BIS and representing the industry on the consultation. “Our working group will continue to meet to address a number of issues such as the impact of the original legislation, the ambiguity and loose definition of the & lsquo;opt out’, the issue of enforcement, transfer fees - and the fact that the transfer fee window does not coincide with the AWR window – as well as the lack of consistency with other regulations such as IR35 and the AWR. We also see this as a good opportunity to again raise the issue of differentiating professional contractors from vulnerable workers.”
