Latest MAC report adopts REC Technology recommendations on ICTs

The Migration Advisory Committee (MAC), the independent body advising government on migration issues, has published recommendations on Intra-Company Transfers (ICTs) as part of its review of Tier 2 visa levels. The MAC recommended retaining ICTs as an important temporary route outside of the immigration cap, and advocated maintaining the minimum salary threshold of &pound40,000 for ICTs lasting over 12 months.

Importantly, the MAC report highlighted the need for proper UKBA enforcement of the ICT rules to avoid any undercutting of UK workers in the labour market, which the REC Technology group has long advocated. This is in response to concerns about the use of allowances in the IT sector to boost salaries to meet the ICT threshold, which can place UK workers at an unfair disadvantage.

REC Technology Chair Jeff Brooks commented:

“It is good news that the MAC has recommended robust UKBA enforcement against companies who abuse the ICT route, yet wisely avoided imposing a cap on this important tool for sharing corporate knowledge. Whilst we wish to see a zero-tolerance approach towards anyone who misuses the ICT provisions, we are pleased that the MAC has not rejected this genuinely valuable route on the basis of a few rogue operators.

“REC Technology supports the strongest possible enforcement to ensure that only those who meet the established criteria can be brought into the UK market as ICTs. This will enable resident workers to compete on a level playing field, whilst allowing large firms to move highly-skilled workers around the globe to share knowledge and best practice.”
