International law firm, Osborne Clarke, held a staffing compliance conference at its London offices on Wednesday 22nd May which brought over 80 staffing company delegates face to face with specialist legal and compliance experts from Singapore, Switzerland, Belgium, The Netherlands, Spain, China and Germany.  Each presenter provided a sector-relevant overview of key compliance challenges and solutions for staffing companies wanting to start up or grow operations in overseas jurisdictions.  Key messages coming out of the sessions included:

Whilst there are certain standard types of risk which occur in many countries, and certain methodologies that can help reduce those risks, there is no one size fits all internationally

Hirers are concerned about supply chain risk and in most countries tax and social security liabilities that bounce up the supply chain are the biggest risk issue that they will want reassurance about

“False” self-employed status will be a significant risk issue in certain countries such as Germany and the US

Sometimes the compliant solution does not work commercially
